1. Violations
a. Plagiarism:
Plagiarism involves copying or reproducing words, ideas, or materials from another source without proper acknowledgment of the original author. This includes:
- Allowing others to alter or revise your work and submitting it as your own.
- Submitting work paraphrased, translated, or modified using automated tools without proper credit.
- Self-plagiarism, where the same work is submitted for multiple assessments or modules without disclosure or permission.
b. Use of Unauthorized Materials:
Using or consulting materials, devices, or tools (such as generative AI like ChatGPT or similar applications) not explicitly authorized for the activity.
c. Unauthorized Collaboration:
Collaborating with others on work or assessments unless explicitly permitted.
d. Contract Cheating:
Paying, trading, or otherwise arranging for someone else to complete work for submission.
e. Impersonation:
Completing work while logged in as another user, or having another person complete work while logged in as you.
f. Unauthorized Sharing of Resources:
Sharing or making solutions, answers, or information about assessments (e.g., homework, quizzes, exams, projects) available to others unless explicitly allowed.
g. Fraud:
Misrepresenting the authorship, conditions, or circumstances of submitted work or falsifying evidence in support of mitigating circumstances claims.
h. Other Violations:
Engaging in any behavior that provides an unfair advantage to yourself or others, or attempting to dishonestly alter results, either to benefit yourself or harm others.
2. Consequences for Violations
SIMS reserves the right to impose appropriate sanctions based on the nature and severity of the violation, the importance of the assessment, and the learner's history of misconduct.
Sanctions may include, but are not limited to:
- Grade penalties or revocation of earned certifications.
- Temporary or permanent suspension of platform access.
- Reporting violations to relevant institutions or stakeholders.
Refunds will not be issued for any actions taken due to Honor Code violations. Determinations of misconduct are at the sole discretion of SIMS, and learners will be notified of the violation and any resulting consequences.

Payment and Refund Policy
1. Changes in the Training Schedule
SIMS (“We” or “Us”) reserves the right to modify, cancel, or reschedule a training course when necessary due to the following:
a. Emergencies, natural disasters, or similar unforeseen events; and
b. Insufficient number of enrollees to conduct the course feasibly.
Except for emergency-related cancellations or rescheduling, trainees will be notified at least forty-eight (48) hours before the original training schedule. If applicable, the new training schedule will also be provided.
For cancellations caused by emergencies, trainees will be informed as soon as it is safe and practical to do so.
2. Payment Schedule
a. Trainees must pay at least 50% of the training fee, or the full amount, to reserve a slot in the training course.
b. The remaining balance must be settled no later than the day before the course concludes.
3. Cancellation
a. Cancellation by SIMS
If SIMS cancels or reschedules a training session and the trainee is unable to attend the new schedule (if provided), the trainee may request a full refund.
b. Cancellation by the Trainee
Trainees may cancel their training enrollment for valid reasons, such as:
- Medical emergencies:
- Doctor’s note or medical report
- Hospital discharge summary
- Prescription medications
- Other emergencies:
- Police reports for accidents or crimes
- Fire department reports
- Official notices related to the incident
- Company-related circumstances:
- Official company memos or announcements
- Earlier embarkation or similar events
- Travel itineraries or agendas
- Medical emergencies:
For valid cancellations, the trainee may choose one of the following options:
- Enroll in a make-up class at no additional cost
- Transfer the training slot to another individual
- Request a refund (subject to the refund terms below)
Cancellation requests must be submitted via email or other approved communication channels, along with relevant supporting documents. Requests without valid reasons will result in forfeiture of any payments made.
Requests for cancellations must be made at least three (3) working days before the training date. Failure to comply will result in forfeiture of any payments made.
Refunds will only be issued for cancellations due to valid emergencies when the trainee is unable to reschedule within a month (e.g., due to early embarkation). The refundable amount is determined as follows:
- For cancellations made three (3) or more days before the training date: 50% of the training fee will be deducted as an administrative fee.
- For cancellations made during the ongoing training: No refunds will be issued.
4. Issuance of Training Certificate
A training certificate will only be issued to trainees who meet the following requirements:
a. Successful completion of all training requirements, including attendance, assessments, and practical evaluations; and
b. Full payment of the training fees.

License to Use Services
Subject to compliance with these Terms and Policies, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Services. This license is for personal, non-commercial use only unless explicitly authorized in writing by SIMS. You are permitted to maintain one user account unless specifically approved otherwise. Sharing access credentials with others or accessing another user's account is strictly prohibited.
Using the Services does not grant you ownership of any intellectual property rights in the Services or the content you access.
Commercial Use

2. Content Offerings
Modifications to Content Offerings
SIMS may design and develop courses and content ("Content Offerings") or collaborate with third-party providers ("Content Providers"). We reserve the right to modify, reschedule, interrupt, or cancel Content Offerings at our sole discretion or as per administrative guidelines and references.
3. Your Content
User Content
You may share content such as homework, quizzes, exams, projects, forum posts, and other assignments ("User Content") through the Services. You retain intellectual property rights to your User Content but remain responsible for its accuracy and compliance with these Terms.
SIMS reserves the right to remove or modify User Content that violates these Terms or related policies, including the Honor Code or Acceptable Use Policy.
Feedback
By submitting feedback, suggestions, or ideas ("Feedback") about the Services, you grant SIMS the right to use your Feedback without restrictions or obligation of compensation. Submission of Feedback does not transfer intellectual property ownership but allows us to implement similar ideas previously developed or sourced from others.
4. Security

7. Modifying or Terminating Services
We continuously enhance our Services and may add or remove features, discontinue specific functions, or terminate certain offerings. If you have purchased a paid Service, you may be eligible for a refund under our Refund Policy. Service availability may vary depending on geographic or regulatory restrictions.
8. Export Controls
By using our Services, you confirm that:
- You are not located in or ordinarily residing in a region subject to restrictions that prevent [CLIENT] from providing Services.
- You are not listed on any government sanctions or restricted-party lists.
- You will not export or transfer Services to restricted parties or regions in violation of applicable laws.
Violation of these conditions may result in immediate termination of Services.
9. Indemnification
You agree to indemnify and hold SIMS, its affiliates, and its partners harmless from claims, damages, and liabilities arising from:
a. Your use of the Services in violation of these Terms.
b. Breach of any applicable laws or third-party rights.
c. Issues related to User Content, including intellectual property claims.
10. Governing Law
These Terms are governed by the laws of the Philippines, excluding conflict of law provisions. Any disputes will be subject to the exclusive jurisdiction of courts located in the Philippines.
11. General Terms
Revisions to the Terms
We reserve the right to revise these Terms at our discretion. Revisions become effective immediately upon posting. Material changes will be communicated through notifications or banners. Continued use of the Services constitutes acceptance of the revised Terms.
Severability and Waiver
